Terms of Sale
About these terms
These terms apply when you buy from the Comera store at store.comeragroup.co.uk (the "store"): courses with dates (in person or live online), eLearning, subscriptions to partner products, books and other products, and certificate fees paid by course providers. Please read them before you buy. At checkout you are asked to confirm that you have read them, and we keep a record of the version you accepted.
Where a section applies only to some purchases (for example subscriptions or eLearning), it says so. Nothing in these terms affects your legal rights as a consumer.
Who you are buying from
You are buying from Comera Movement Science Ltd, a company registered in England and Wales (company number 03854711), VAT number GB749322713, registered office Origin Workspace, 40 Berkeley Square, Bristol BS8 1HP ("Comera", "we", "us"). Contact: support@comeragroup.co.uk.
Comera Movement Science Ltd sells everything in the store, for itself and on behalf of the other companies in Comera’s group. Each course is delivered by the Comera group company named on the course page, or by one of its accredited tutors, course organisers or licensed franchise partners (together, "course providers"). Partner products (such as Wibbi exercise software, or an eBook supplied by its publisher) are provided by the partner named on the product page; we sell them and take payment.
Definitions
- Consumer: an individual buying wholly or mainly for purposes outside their trade, business, craft or profession - typically someone booking a course for themselves and paying personally.
- Course date: a dated course (in person or live online) shown with its date, place and course provider.
- eLearning: a self-paced online course provided through our learning platform, with an access period stated on the product page.
- Group: means any subsidiary of Comera, any holding company of Comera, or any subsidiary of any such holding company, as those words are defined in section 1159 of the Companies Act 2006.
- Organisation booking: a purchase made for or on behalf of a business, clinic, employer, sports club or other organisation, or by an individual for the purposes of their profession or business - including when you book for other people, pay by invoice, or give a company name or VAT number at checkout.
- Place: one person's place on a course date.
- Subscription: a partner product paid for monthly or yearly until cancelled.
Your account
You can buy without an account. If you create one, you sign in with your email address and password plus a code we email you or an authenticator app or passkey. Keep your sign-in details private; you are responsible for purchases made through your account. Course providers and staff must use an authenticator app or passkey.
Prices and payment
- Prices are in pounds sterling (GBP) unless another currency is shown.
- Prices shown to consumers include VAT. Organisations can switch to prices shown without VAT; VAT is added at checkout. The VAT charged depends on what you buy and where, and is confirmed before you pay.
- Card and other online payments are taken by our payment provider, Stripe, on its own secure page. We never see or store your card details.
- Some payment methods (for example bank debits) take a few days to clear. They are only offered when the course starts far enough ahead; your places are held as "payment processing" until the payment clears, and released if it fails.
- Approved organisations may, if we agree in writing in advance, pay by invoice on the payment terms shown on the invoice. Places, access and certificates may be withheld until an overdue invoice is paid.
- Discount codes apply only as stated with the code, can't be exchanged for cash and can be withdrawn at any time before an order is placed.
- If we've made an obvious error in a price, we will tell you and you may either pay the correct price or cancel for a full refund.
How the contract is made
Your order is an offer to buy. The contract is made when we email you an order confirmation after payment (or, for invoice orders, when we confirm the order). While you are paying, places on a course date are held for a short time; if payment isn't completed they are released. If a course date becomes full or unavailable before your order is confirmed, we will refund anything you have paid.
Course dates
Booking places and naming attendees
If you book places for other people, you can name them at checkout or later using the link in your confirmation email. You confirm that you are entitled to give us their names and email addresses for the booking. Each named person receives their joining details by email. The names of people on organisation bookings may be changed at any time before the course starts.
Eligibility and conduct
Some courses are for qualified professionals only, as stated on the course page, and must not be booked by or for people who are not so qualified. Attendees must follow the course provider's reasonable instructions, including health and safety instructions for practical sessions. A course provider may ask an attendee to leave if their conduct puts others at risk or seriously disrupts the course; no refund will be payable in such cases.
Changes to a course date
We or the course provider may need to change the venue, time, format or tutor of a course date. If a change is significant (for example a different date, or in-person changed to online), we will tell you and you may accept the change or cancel for a full refund of that place.
If a course date is cancelled
If we or the course provider cancel a course date, we will tell you and give you a full refund of what you paid for it, or, if you prefer, move you to another date. We are not responsible for travel, accommodation or other costs you have incurred, so we recommend booking travel that can be changed or arranging appropriate insurance.
eLearning
- Access is given through our learning platform. We email the learner their sign-in details when payment is complete; organisations can buy eLearning for named learners, each enrolled with their own email address.
- Each eLearning product has an access period stated on its page, starting when access is given. Some products include several courses, each with its own access period.
- Where offered, you can buy an extension before or after access ends, at the price shown. An extension restarts the access period and keeps the learner's progress.
- Some products are offered in more than one language; you choose the language when you buy, and the learner is enrolled in that language's course.
- Access is for the named learner only and must not be shared.
Subscriptions
- A subscription renews automatically every month or year, at the price you agreed, until you cancel. We take each payment through Stripe; the partner sets up and provides the product.
- You can cancel at any time online using the link in your emails. Upon successful cancellation no future payments will be taken, and your access continues to the end of the period you have paid for.
- We will tell you in advance of any price change, and you may cancel before it takes effect.
- If a payment fails, we will try again over the following days; if it still fails, the subscription will end and your access will be withdrawn.
Books and partner products
Some products are supplied by a partner, for example an eBook supplied by its publisher through the publisher's own reading platform. The product page says how it is delivered and how long access lasts. Where a product is digital content supplied straight away, you will be asked at checkout to agree to that, and you then lose the right to cancel once it has been supplied (for an eBook, this is as soon as the access code has been issued).
Your right to cancel (consumers)
If you are a consumer, you have the right to cancel within 14 days without giving a reason. The 14 day period starts on the day the contract is made.
- Course dates: cancel within 14 days for a full refund, provided the course hasn't started. If you asked us to start providing the course within the 14 day period and then cancel after it has started, you must pay for what has been provided up to the time you cancel.
- eLearning and other digital content: if you asked for access straight away and acknowledged that you lose the right to cancel once access starts, you can no longer cancel once access has been given.
- Subscriptions: cancel within 14 days of subscribing for a full refund of your first payment; the subscription then ends straight away.
To cancel, tell us clearly - by email to support@comeragroup.co.uk, or by post to the address above. You may use the model cancellation form at the end of these terms, but you don't have to. We refund within 14 days of being properly informed of your request to cancel, using the payment method you used, and charge no fee.
Organisation bookings
Organisation bookings are not refundable, but the person named on a place can be changed at any time before the course starts. eLearning bought for named learners can't be transferred once the learner has been enrolled. If we or the course provider cancel a course date, organisations receive a full refund as above.
Certificates
- Certificates are issued to attendees who complete the course and meet its assessment requirements, as confirmed by the course provider. They are issued only after the course and once the certificate fee has been paid.
- Certificates are digital. The certificate holder signs in to their account to view and download it; we email them when it is ready.
- Anyone can check a certificate online using its number and the holder's surname.
- We may withdraw a certificate that was issued in error or obtained dishonestly, or if the course provider tells us the attendee did not complete the course. The online check then shows it as withdrawn.
- Certificate fees are paid by the course provider, not the attendee, and are not refundable except where a certificate was issued or charged for by mistake.
Course materials and intellectual property
Course materials, eLearning, videos, assessments and certificates are owned by Comera or its licensors. You may use them for your own learning and professional practice, but you must not copy, record, share, sell or publish them, or use them to teach others, without our written permission.
Our responsibility to you
We provide our courses and products with reasonable care and skill and as described. Course content is for education and continuing professional development; it does not replace your own professional judgement, and you remain responsible for how you apply it in practice. We make no representation that the course or product is fit for your specific purposes. None of the courses or products constitute medical training, medical advice or medical treatment.
We are not responsible for losses that were not foreseeable, or for business losses (such as lost profits or lost business opportunities) or any direct, indirect, special, incidental, consequential, or punitive damages or any other damages whatsoever, whether in an action of contract, statute, tort (including, without limitation, negligence), or otherwise. Our total liability for any order is limited to the price paid for it. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not allow us to limit.
We are not responsible for delays or failures caused by events outside our reasonable control (for example illness of a tutor, severe weather, travel disruption or the failure of a venue); if a course date can't go ahead for such a reason, we will offer another date or a full refund.
Complaints
If something goes wrong, please contact support@comeragroup.co.uk. We aim to reply within five working days and to resolve complaints within 30 days.
Changes to these terms
We may update these terms from time to time. The terms that apply to your order are the version you accepted at checkout, which we record with your order.
Group company rights
Each of our group companies shall have the right to enforce these terms to the extent that anything sold in the store is sold for or on behalf of such company. No one else shall have any rights under these terms under the Contracts (Rights of Third Parties) Act 1999.
Law and jurisdiction
These terms, and any dispute arising out of or in connection with them, are governed by English law. Consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts, and keep the protections of their local consumer law. All others submit to the exclusive jurisdiction of the courts of England and Wales.
If any provision of these terms (or part of a provision) is found by any court or administrative body of competent jurisdiction to be invalid, unenforceable or illegal, the other provisions shall remain in force. If any provision that is invalid, unenforceable or illegal in a jurisdiction would be valid, enforceable or legal in that jurisdiction if some part of it were deleted, the provision shall apply, in that jurisdiction, with whatever modification is necessary to give effect to the commercial intention of the parties, and in every other jurisdiction, all of these terms shall remain in full force and effect.
